Are AI Cover Songs Legal? 🦹♀️
It depends on what you do with them. Making an AI cover for a laugh is one thing, but sharing one that clones a real artist's voice can land you in hot water, so always read the terms and conditions closely before sharing your AI covers.
Here's a few things to watch out for:
- A voice isn’t copyrighted, but it is protected. The US Copyright Office says a voice can’t be copyrighted, but right of publicity laws protect it in many US states. Bette Midler and Tom Waits both won cases against ads that used sound-alike singers, and Tennessee’s 2024 ELVIS Act extended its law to cover AI voice simulations.
- The song and the recording are copyrighted. Most AI covers keep the original instrumental, which is someone else’s recording (usually owned by a record label), and the song itself belongs to its songwriters. Sharing a full cover online without a licence could infringe both.
- Platforms have their own rules. Spotify only allows vocal impersonation when the artist has authorised it, and YouTube lets music labels request the removal of AI music that mimics an artist’s singing or rapping voice.
- Don’t count on fair use. It’s decided case by case, so there’s no “safe” clip length for sharing an AI cover.
- You’re responsible. Jammable’s own FAQ says users need the rights to the underlying song and voice, and rights holders can have voices taken down under its DMCA policy.
The law is still moving too. A federal US bill to protect people’s voices and likenesses, the NO FAKES Act, was reintroduced in Congress in April 2025 with backing from YouTube, OpenAI and record labels. Use AI covers carefully until more legal clarity emerges.
